Domestic Leads to Battery on Police

On January 9, 2019 at approximately 3:45 PM Parsons Police Officers responded to assist with an alleged Domestic Battery case. The victim came to the Parsons Police Department and reported that her husband, David Phelan, had battered her. Officers were notified of the address Phelan was at and responded to continue the investigation.

Officers were able to locate Phelan at an address in the 2400 Block of Appleton, with the intent to arrest him for Domestic Battery. Two Parsons Police Officers attempted to take Phelan into custody as is required by Kansas Domestic Battery Violence statutes. Phelan resisted both officers causing injuries to both during the fight. Phelan was reported as "Mule Kicking" Officers during the arrest potentially causing serious damage to the lower extremities and knees of one of the arresting officers.

Phelan was taken into custody and will be charged with Domestic Battery, Battery of a Law Enforcement Officer (Felony), and Interference with the Official Duty of a Law Enforcement Officer. Phelan has an extensive history of Battery and Domestic Battery. He currently is being held at the Parsons Police Department jail waiting to be seen by a District Judge.

Parsons Police Chief Robert Spinks says "You may fight with the Police, but you will not win. We will continue to bring violent offenders to justice and bring them before a Judge." Spinks continued, "while our objective is to treat all individuals in a fair, firm and friendly manner, our staff will bring to bare the full weight of the criminal justice system whenever my officers are attacked by violent, aggressive known criminals."
